A Marseilles man who claimed he had a gun pointed at him received 30 months probation for filing a false police report.
According to the LaSalle County Circuit Clerk’s Office, 46-year-old James Despain pleaded guilty last week to Filing a False Police Report, a Class 4 felony.
In early August, the Marseilles Police Department arrested Despain at the Marshall Gas Station in Marseilles.
Despain told police that as he was leaving the gas station, a male subject approached him and asked for help.
Despain told police he agreed to help the man and began walking to the side of the building.
Upon reaching the side of the building, Despain stated that the male subject pointed a gun at him.
Despain said he punched the subject in the face, knocking him down and then left the area.
Despain then went home and decided to report it to the police after discussing the matter with others.
After review of the video evidence and interviews of potential witnesses, the police concluded the incident did not occur.
As part of the plea deal, Despain must receive mental treatment.
